A proposed Bitcoin futures product by Gemini was the subject of a 2022 CFTC charge for false or misleading statements about the product. Gemini settled the case in January 2025 for $5 million. In October 2026 Gemini asked to vacate that settlement; U.S. District Judge Alvin Hellerstein denied the request, maintaining the permanent injunction that bars Gemini from making false statements to the CFTC and from denying the settlement’s findings. Gemini’s $5 million penalty remains paid and not refundable.
